2. Intellectual property rights

 

2.1 Ownership

ARSEN is the owner of the Site’s domain name. The Site as a whole, as well as its component parts (notably: texts, tree structures, animations, photographs, videos, illustrations, diagrams, graphic representations, logos, etc.) constitute intellectual works protected by articles L. 111-1 et seq. of the French Intellectual Property Code. They are the exclusive property of ARSEN, which alone is entitled to use the said intellectual property rights and the related personality rights, trademarks, models, intellectual works, databases, interpretations and images of persons, whether on an original basis or by virtue of a license or express authorization.

 

2.2 Sanctions

The use of all or part of the Site, in particular by downloading, reproduction, transmission, representation or distribution for any purpose other than for the personal and private use of the Internet user for non-commercial purposes, is strictly forbidden. Infringement of ARSEN’s rights exposes its author to the penalties provided for both by the French Intellectual Property Code, in particular for copyright infringement (article L. 335-1 et seq.) and trademark infringement (article L. 716-1 et seq.), and by the French Civil Code in terms of civil liability (article 9, articles 1382 et seq.).

 

2.3 Hypertext links

The creation of any hypertext links to any of the Internet pages or elements making up the Site is prohibited without the prior written authorization of ARSEN, which authorization may be revoked at any time. All sites with a hypertext link to the Site or any of its components are not under ARSEN’s control, and ARSEN therefore declines all responsibility, in particular editorial responsibility, for the access and content of these sites.

 

 

3. Personal data

 

This section is dedicated to ARSEN’s privacy protection policy, and sets out the origin and use of navigation information processed when Internet users consult the site, as well as their rights. This policy is therefore important for Internet users, who wish to have a positive and confident experience on the Site, and for ARSEN, which wishes to respond in a precise and complete manner to Internet users’ questions about consulting and using the Site, and to take account of their wishes.

 

3.1 Nature of personal data

Personal data means any personal information (in particular: surname, first name, date of birth, e-mail and postal addresses) that Internet users may provide to ARSEN in the context of any message sent to the Site via the “Contact” section and/or when using the Site and the services offered therein. This data, whatever its nature, may enable ARSEN, directly or indirectly, to identify and get to know Internet users better and to send them its newsletter and/or reply to their messages and/or facilitate their browsing on the Site and/or optimize the quality of the services offered to them. When Internet users provide personal data, they undertake to answer the questions put to them and to provide ARSEN with complete, accurate and up-to-date information that is not prejudicial to the interests or rights of third parties.

 

3.2 Consent

No personal data is collected without the consent of Internet users. Internet users will be informed in advance of the optional or mandatory nature of the information to be communicated to ARSEN as part of the data collection carried out on the Site. Internet users are under no obligation to provide ARSEN with personal data.
However, in the event of refusal, ARSEN will not be able to send Internet users its newsletter and/or reply to their messages and/or facilitate their browsing on the Site.
If the Internet user does not wish to receive or no longer wishes to receive the ARSEN newsletter, he/she may notify ARSEN by sending an e-mail to the following address: marylise.debuchy.arsen@gmail.com. In any event, Internet users are also offered the option of unsubscribing from the ARSEN newsletter by clicking on a hypertext link appearing directly on each issue of the newsletter sent to them.

 

3.3 Identity of the party responsible for processing personal data

ARSEN is responsible for the collection and processing of personal data on the Site.

 

3.4 Recipient(s) of personal data

The ARSEN company is the sole recipient of the personal data collected on the Site and is only likely to transmit them to a third party when the Internet user has given his prior consent to such transmission; the said third party intervenes, as a subcontractor of the ARSEN, within the framework of the provision of the Site and the services offered therein; the ARSEN is summoned by a judicial authority or any other administrative authority to communicate such data to it.

 

4.Responsability

 

ARSEN makes every effort to ensure that the information published on the Site is accurate and up-to-date, and reserves the right to correct the content at any time without notice. However, ARSEN cannot guarantee the accuracy, precision or completeness of the information made available on the Site, which information constitutes neither a guarantee nor a commitment on the part of ARSEN with regard to the Internet user.

In particular, ARSEN cannot be held responsible for any imprecision, inaccuracy or omission concerning the information available on the Site; for any damage resulting from computer intrusion by a third party leading to modification of the information made available on the Site; and more generally, any damage, direct or indirect, whatever the cause, origin, nature or consequences, caused by any person’s access to the Site or inability to access it, or by use of the Site and/or reliance on any information obtained directly or indirectly from it.

ARSEN implements measures intended to ensure the security of files constituted from personal data collected on the Site. However, ARSEN does not control the risks associated with the operation of the Internet and draws the attention of Internet users to the existence of possible risks in terms of confidentiality of data transiting via this network.

 

5. Changes to the legal notice

 

ARSEN informs Internet users consulting the Site that these legal notices may be modified at any time. These modifications are published when they are put online and are deemed to be accepted without reservation by any Internet user accessing the Site after they have been put online.

 

6. Disputes

 

The present disclaimer is drawn up in accordance with French law, and in particular with the provisions of law no. 78-17 of January 6, 1978 relating to data processing, data files and individual liberties.
